Tire Defects
Tread separations and other tire failures are caused by tire defects. Tire defects occur due to poor design and manufacturing practices, the use of poor quality materials, and “aged” tires – i.e. tires that have broken down over time.
Vehicles moving at normal speeds that experience a tread separation or blowout can experience a total loss of vehicle control. Some tire failures can cause the vehicle to experience a rollover, causing catastrophic injuries or death to those involved.
In the mid 1990s, numerous documents became available to the public which revealed the fact that tire manufacturers knew that their tires were failing prematurely. When confronted with accusations about the performance of their tires, manufacturers misleadingly claim owner abuse (i.e. under-inflation, improper use or repair) as the cause.
Despite prior knowledge of these tire defect and design issues, most manufacturers never designed enough safety precautions into their vehicles or tires.
For example, the use of nylon cap plys will boost a tire’s ability to withstand tread separations. The cap plys act like a girdle to hold the internal tire components together in case of a blowout. They also prevent the tread from separating. Tire companies have known about cap plys for years, yet they are still reluctant to incorporate them into all of their tire designs due to cost - which typically amounts to less than one dollar per tire.
If you have been injured in an accident involving a failed tire, you need to preserve the vehicle, the tires, and any tread from the tires that may have separated at the scene. This evidence is very important to the prosecution of your case, and should be maintained in a safe place until you can turn them over to your attorneys.
