Representative Cases

Hurricane Rita Bus Fire Litigation – 2005-2009  Robert Luke and Tad Rice, along with a team of other lawyers, represented the families of 23 nursing home residents who died in a bus fire.  There were products liability, poor maintenance and medical negligence claims alleged.  A number of defendants were sued, including the bus company, driver, towing service, service company and bus and component part manufacturers.  The investigation found that an overheated axle caused the fire and that poor maintenance was a contributing factor.   An $88 million dollar settlement was obtained.

PP v. Trucking Company – 2008

Represented California residents who suffered severe orthopedic injuries and permanent disability when their vehicle was hit by an 18 Wheeler that failed to maintain its lane and ran over their car.  A confidential settlement was reached.

Conner et al. v. British Petroleum (BP) – 2007

Represented over 40 victims of one the deadliest explosions in recent history at the BP Chemical plant in Texas City, Texas.  Using satellite imagery and glass repair information subpoenaed from local businesses, Mr. Rice helped prove the size and severity of the explosion throughout Texas City.  All clients received confidential settlements.

CS v. Trucking Company – 2005

Represented a Montgomery County resident who suffered severe brain damage and permanent disability when her vehicle was hit by an 18 Wheeler that ran a red light.  A confidential settlement was reached.

Garcia v. Edwards Life Sciences, Inc., et al – 2003

In a case involving medical negligence and products liability issues, assisted representing the family of an individual who suffered severe brain damage after a perfusionist failed to properly maintain proper oxygen levels in the patient during heart surgery.  Recovered the largest (confidential) settlement in history against Edwards Life Sciences.

Martinez v. U-Haul Corporation – 2002

In a case involving negligence and products liability issues, assisted representing the family of two individuals who suffered severe 3rd degree burns when an overfilled propane tank exploded.  Recovered the largest (confidential) settlement in history against U-Haul Corporation.

JG, et al v. Apartment Complex Fire – 2002

Assisted representing multiple families involved in an apartment fire.  One individual was killed, another suffered severe 3rd degree burns and many others suffered property damage as a result of improper fire barriers and maintenance. The case was resolved confidentially.

EH & SH v. Homebuilder and Electrical Contractor – 2002

Assisted representing two construction workers who were injured on a job site.  One brother was killed and another suffered injuries as a result of improper construction practices and inadequate protections to guard against contact with power lines.  Confidential settlement.
